U.S. Circuit Court of Appeals Vacates District Court's Judgment Filed Against Cigna Health

The Third U.S. Circuit Court of Appeals vacated a district court's judgment and held that an agreement between a health insurer and two medical device makers did not require arbitration of the device makers' claims arising from the insurer's decision to withdraw coverage for plan participants' use of the makers' devices. Because the claims did not require construction of the agreements executed between the device makers and the insurer, they were not subject to arbitration. CardioNet Inc. and LifeWatch Services Inc. provide medical devices that allow physicians to monitor cardiac arrhythmias in patients not confined in the hospital. In 2012, CIGNA announced it would no longer provide such coverage. The plaintiffs sued CIGNA on their own behalf and as assignees of their patients, alleging ERISA violations and common law claims. A district court found the claims fell within the arbitration provisions contained in the agreements executed between the plaintiffs and CIGNA, and ordered arbitration. The plaintiffs appealed. The Third Circuit found the arbitration provisions at issue related only to disputes 'regarding the performance or interpretation of the agreement. The plaintiffs' trade libel, Lanham Act and tortious interference claims rested on identical factual assertions, including that CIGNA made false statements in a physician update about the nature of outpatient cardiac telemetry and that CIGNA falsely stated that outpatient cardiac telemetry would never be covered under plans it administered.
