Victims of Contaminated Steroid Injections to Share $100 Million Settlement Against New England Compounding Center, Attorneys with Janet, Jenner & Suggs

Victims of contaminated steroid injections who sued in federal courts will share a $100 million settlement against the New England Compounding Center (NECC), attorneys with Janet, Jenner & Suggs, LLC. The settlement was tentatively agreed upon last December. It was officially filed with the bankruptcy court, which must approve it. The bankruptcy court is overseeing NECC's bankruptcy, filed in 2012. The settlement is with NECC, NECC's owners, related companies, and insurers. The Case is In re: New England Compounding Pharmacy Inc. Products Liability Litigation, MDL No. 2419, in the U.S. Judicial Panel on Multidistrict Litigation (MDL). The announced settlement covers all claims against NECC filed in with the bankruptcy claims administrator.

Plaintiffs' Steering Committee Announces Settlement with the Owners, Operators and Insurers of the New England Compounding Pharmacy, Inc

The Court-appointed Plaintiffs' Steering Committee (PSC), charged with speaking for hundreds of victims of tainted steroids produced by the New England Compounding Pharmacy, Inc. announced a preliminary settlement with the owners, operators and insurers of the bankrupt NECC. A conditional agreement has been reached between bankruptcy trustee Paul D. Moore, the PSC and the Unsecured Creditors Committee under which the Cadden and Conigliaro families, the insurers of NECC and related company Ameridose, have promised to pay to a compensation fund an amount that may exceed $100 million. This fund will allow victims who received injections of tainted steroids made by NECC to seek a measure of justice against those wrongdoers. The agreements are not final, require due diligence on the part of the PSC to ensure the rights to victims are protected under these agreements, and will be conditional upon approval by creditors and a federal court for fairness and adequacy.

Kim Dougherty to Help Lead Plaintiffs Cases Against New England Compounding Center

Kim Dougherty, an attorney and Manager of the Boston office of Janet, Jenner & Suggs, LLC, has been appointed to the Plaintiffs Steering Committee (PSC) in litigation against New England Compounding Center over allegations related to a national outbreak of fungal meningitis. The PSC will coordinate discovery, hearings, trial, and settlement negotiations on behalf lawsuits filed in federal courts against NECC, according to the order issued Tuesday by U.S. District Judge F. Dennis Saylor, of the District of Massachusetts. Saylor is presiding judge over the Multi District Litigation (MDL) established to consolidate procedures for some 150 lawsuits against NECC filed in federal court.
