Three pharmacies have sued Express Scripts, Inc. for violations of federal regulations in a scheme to deny payments for compound pharmaceuticals. The suit alleges that thousands of patients are being impacted by the scheme. The suit was brought in federal court in St. Louis on behalf of three compound pharmacies, two based in Texas and one in Louisiana. Express Scripts (ESI), based in St. Louis, is described as the largest U.S. claims administrator and fiduciary for health plan pharmacy claims. According to the suit, Express Scripts has recently undertaken a scheme to reject all claims under health plans seeking payment for "compound" pharmaceuticals. These medicines are customized drugs made according to specific prescriptions written by doctors when there are no alternative medicines available that are either mass-produced or commercially made. Patients suffering from various conditions, diseases and injuries benefit from these medications every day, according to the suit. To date, the suit alleges that the ESI scheme has resulted in denial of needed care to thousands of patients. ESI is violating the federal claims regulation that governs all group health plans in the United States by not disclosing information as to what health plan changes - if any - have led to denial of the pharmacy claims as allegedly - and suddenly - "excluded" as "not covered" under the patients' health plans. The suit seeks a declaratory judgment that all claim denials are unlawful and void and an injunction ordering ESI to continue making payments for all compound medications that have always been covered - unless and until it can issue lawfully compliant claims decisions. The required ERISA disclosures will allow patients and pharmacies to uncover the truth as to each health plan's coverage so that claim denials can be appealed and challenged under the ERISA regulation's procedures or in a federal court.

Express Scripts Collaborates with Walgreens to Create Value-Driven Medicare Prescription Drug Plan Pharmacy Network

Express Scripts announced that its two nationally available 2015 Express Scripts Medicare(R) Prescription Drug Plans (PDP) will offer a preferred retail pharmacy network featuring Walgreens. Medicare beneficiaries who enroll in the Express Scripts Medicare Value or Choice plans for 2015 can save significantly -- with $0 or $1 copayments, respectively, for Tier 1generic medications -- when using one of the more than 27,000 pharmacies in the plans' preferred retail network. The network includes approximately 8,200 Walgreens pharmacies nationwide and more than 18,500 community pharmacies. The preferred pharmacy network also offers reduced copayments for Tier 2 generics, preferred and non-preferred brand name medications. In addition to the savings available through the preferred retail pharmacy network, enrollees in the Express Scripts Medicare Choice plan benefit from a $0 deductible for Tier 1 and Tier 2 generics, and $0 copayment for 90-day supplies of Tier 1 generics from the Express Scripts Home Delivery Pharmacy.
