Smart Pharmacy and Highland Pharmacy Putative Class Action Against Medco Health Solutions Dismissed

The U.S. District Court for the District of New Jersey dismissed a putative class action brought by two pharmacies against a Medco Health Solutions, Inc. after concluding the pharmacies failed to allege facts showing any personal injury to the pharmacies themselves. Smart Pharmacy Inc. and Highland Pharmacy L.L.C. brought a class action against Medco Health Solutions, Inc. responsible for processing and paying prescription drug claims. The complaint alleged that, when members of a "Vacation Supply Class" would grant patient requests for early refills to ensure patients were supplied while on vacation, Medco improperly determined that these claims constituted a "Refill Too Soon" discrepancy, and improperly recovered monies from this the Vacation Supply Class based on those discrepancies. Smart alleged further alleged that claims submitted to Medco by members of an "Overpriced Compound Class"-comprised of pharmacies that offered patients a compounding prescription service-were subjected to an improper adjudication system, resulting in Medco's recoupment of monies not properly owed to Medco. Medco moved to dismiss. The court held that the complaint failed to contain allegations specific to either of the two named plaintiffs as required to support a class action claim. Although the complaint alleged a significant amount of facts indicating the existence of a claim and thoroughly discussed the nature of that claim, the plaintiffs failed to present facts showing that they personally were injured by Medco's alleged improper practices and that they personally had a right to relief. As an example, the complaint failed to indicate details of the specific contracts between Smart and Medco and between Highland Pharmacy L.L.C. and Medco, or whether Smart and Highland suffered harm by having monies recouped by Medco as opposed to having monies currently subject to being recouped. Accordingly, Medco's motion to dismiss was granted, and the action was dismissed without prejudice.
