Minnesota Couple Files Lawsuit Against American Family Mutual Insurance Company

A Minnesota couple alleges that American Family Mutual Insurance Co. routinely overcharges consumers by overvaluing the replacement cost of personal property in their residences. The lawsuit, filed in Hennepin County District Court, maintains that Charles and Darlene Nelson purchased their insurance policy in 2004 with a replacement value on their home of $184,000 and personal property at $147,000. By 2011, they were being charged for replacement value of $454,000 for their home and personal property of $363,000. The Nelsons claim their property is not worth anywhere near $363,000. The suit alleges that American Family arbitrarily sets personal property coverage at 80% the cost of the dwelling. The Nelsons allege that there are likely other policyholders damaged by the scheme and seek class action status in their lawsuit.
