American Arbitration Association Key Developments

American Arbitration Association Launches Mediation.org to Promote and Enhance Mediation Education, Practice, and Growth; Appoints Harold Coleman, Jr. as Executive Director and Mediator of Mediation.org

American Arbitration Association launched a new division, Mediation.org(TM), to expand the Association's focus on the fast-growing mediation component of the alternative dispute resolution (ADR) field. Making the announcement at the American Bar Association's Section of Dispute Resolution meeting in Chicago, AAA President and CEO India Johnson announced Harold Coleman, Jr., Esq., a 26-year veteran who has multiple levels of arbitration and mediation experience, will serve as Mediation.org's Executive Director and Mediator. Mr. Coleman, who has been a member of the AAA's Panel of Arbitrators since 1987, will be actively involved in mediations in addition to directing Mediation.org's activities, according to Ms. Johnson. Mr. Coleman was previously a member of the AAA's Board of Directors until he joined Mediation.org. In addition to education, Mr. Coleman explained that Mediation.org will offer mediation parties unique services to assist them in finding the right mediator for their individual needs. Mediation.org will also provide a resource for non-legal matters, such as social services and family disputes. Mediation.org services will be available on a worldwide basis to private and public sector entities.

American Arbitration Association Launches Online Clause Building Tool

American Arbitration Association launched ClauseBuilder, an online arbitration and mediation tool that assists individuals and organizations in drafting clear and effective arbitration and mediation agreements. The new tool provides parties with the AAA's standard arbitration agreement, in addition to an array of options parties may consider when crafting customized ADR clauses, including specifying the number of arbitrators; arbitrator qualifications; locale provisions; governing law; the duration of arbitration proceedings; and whether to use arbitration, mediation, or both. The current version of ClauseBuilder deals with commercial arbitration contracts. Future versions in development will address construction, international and employment contracts. ClauseBuilder enables users to develop pre-dispute ADR clauses to be included in contracts as well as clauses for existing disputes that parties would like to submit to arbitration or mediation. In addition to creating ADR clauses, ClauseBuilder will allow users to preview, edit, and archive their ADR agreements.
