El Pinto Foods LLC Announces Trial Date for its Lawsuit Against Ocean Spray Cranberries Inc

El Pinto Foods LLC announced that a trial date has been set for its lawsuit against Ocean Spray Cranberries Inc. alleging the company breached a three-year contract under which El Pinto Foods would manufacture Ocean Spray Cranberry Relish. El Pinto officials sued Ocean Spray in 2012 after it had agreed to pay El Pinto $5 per case for 200,000 cases per year of salsa and relish. El Pinto announced it spent about $1 million upgrading its factory to produce the cranberry products. The trial is set for Aug. 18 in U.S. District Court for the District of New Mexico before U.S. Magistrate Judge Karen B. Molzen (case No. 1:12-cv-01293-KBM-RHS). El Pinto announced that after two years of research and development, Ocean Spray decided to produce the salsa in Canada instead and walked away from the contract. Ocean Spray claimed that El Pinto's factory failed a crucial 'commissioning' test, but El Pinto said on the day of the test, a massive windstorm caused electrical brown-outs in the North Valley, which slowed the production line. Despite its own internal procedures requiring a retest, Ocean Spray used this incident as an excuse to breach its contract. Ocean Spray officials declined requests by El Pinto to reimburse the money spent on upgrading the factory, prompting the lawsuit. The lawsuit further alleges that Ocean Spray is using trade secrets and production methods it learned from El Pinto to produce salsa in Canada.
