Family of Pathmark Shooting Victim Files Negligence Suit Against Four Companies
May 21 13
The family of one of the victims killed in the shooting at Pathmark of Old Bridge nine months ago has filed a civil suit against the store chain, charging that failure to follow store policies and screen job applicants led to her death. Maria LoBrutto, representing her daughter Cristina's estate, said store policy prohibited anyone from leaving the store during the overnight shift 'for the safety of all of those working.' But supervisors on the shift allowed Terrance Tyler to leave in the early morning hours of Aug. 31 and no one working at the store took any steps to determine where he was or why he left or to secure the building. The suit, filed in Superior Court in Middlesex County, claims 'managers and agents' of the store 'propped the front door of the building open in contradiction to the policies of the company.' Tyler, a 23-year-old former Marine, returned to the store, dressed in Army fatigues and carrying a semi-automatic rifle. He opened fire, targeting no one in particular, and killed LoBrutto, 18, and Bryan Breen, 24, both store employees, before killing himself, authorities said. The suit names Pathmark Stores Inc.; its parent company, the Great Atlantic and Pacific Tea Company (A&P); Pathmark of Old Bridge Inc.; and unnamed employees as defendants. The suit also names Garden Commercial Properties, owner of the property and building leased by Pathmark in Old Bridge, as a defendant, charging the company should have provided better security for tenants.
