KFx Medical Corporation announced that it has entered into a license agreement with Smith & Nephew Inc. relating to its patents used in knotless double row rotator cuff repair. Under the agreement, Smith & Nephew will have the right to promote the use of products and techniques for knotless double row rotator cuff repair as claimed in US Patent number 7,585,311 and related patents and applications for the life of those patents. Approximately one-third of more than 400,000 rotator cuff repairs in the United States utilize the technique to achieve an anatomic reattachment of tendon. The new AppianFx line of implants from KFx reattach tissue to bone in shoulder, knee, foot and ankle procedures which combined exceed well over 1 million annual surgical procedures in the United States. Product offerings include those that directly place and secure tissue into bone both with and without the use of sutures.
Travelers Property Casualty Corp. Sues KFx Medical Corporation to Avoid Coverage in Patent Case

Travelers Property Casualty Corp. has filed a lawsuit alleging it does not owe a defense to its insured in an underlying patent infringement case. Travelers issued a commercial policy to KFx Medical Corporation in 2011. KFx Medical Corporation subsequently filed an underlying lawsuit against a competitor for infringement of patents covering methods for attaching soft tissue to bone, a process used to repair torn rotator cuffs. The underlying defendant filed a counterclaim alleging KFx Medical Corporation's patents are invalid and unenforceable, and KFx Medical Corporation tendered the defense of the counterclaim to Travelers. The insurer alleges that it does not owe coverage for the underlying case because there is an exclusion for intellectual property. The policy also excludes advertising injuries, which Travelers alleges is involved in the underlying case.
