The Sixth U.S. Circuit Court of Appeals affirmed a district court's dismissal of an action brought by two employee benefit plan participants against a plan administrator alleging a civil Rackateer Influenced and Corrupt Organizations Act (RICO) claim, arising from an alleged conspiracy to avoid paying benefits conducted by the administrator, the plaintiffs' employer and a physician. Clifton Jackson and Christopher Scharnitzke, employees of Coca-Cola Enterprises Inc., each suffered work related injuries and applied for workers' compensation benefits from Coca-Cola through Sedgwick Claims Management Services Inc. Sedgwick disputed both of the claims and refused to pay benefits. Jackson and Scharnitzke sued Sedgwick, Coca-Cola and Dr. Paul Drouillard, alleging the defendants engaged in 'a fraudulent scheme involving the mail' to avoid paying benefits that they were owed. The district court dismissed the complaint pursuant to Fed. R. Civ. P. 12(b)(6). A panel of the Sixth Circuit reversed in reliance on an applicable Sixth Circuit precedent, and the Sixth Circuit granted the defendants' motion to review en banc. The Sixth Circuit held that the losses alleged by the plaintiffs were simply a shortcoming in the compensation they believed they were entitled to receive for a personal injury. They were thus no different from the losses the plaintiffs would experience if they had to bring a civil action to redress their personal injuries and did not obtain the compensation they expected to receive.
