The U.S. District Court for the Southern District of Florida dismissed a lawsuit relating to the marketing of food products for lack of subject matter jurisdiction. The plaintiff did not meet her burden of establishing that the amount in controversy exceeded $5 million. Leslie Reilly purchased products produced by Amy's Kitchen Inc. The labels for those products listed evaporated cane juice as an ingredient. Reilly claimed the labels were false and misleading. She commenced a class action lawsuit against Amy's Kitchen. The complaint alleged that evaporated cane juice is actually sugar and Amy's Kitchen used the term evaporated cane juice to make its products appear healthier than those containing sugar. Amy's Kitchen moved to dismiss the complaint, arguing Reilly did not establish the class action Fairness Act's amount in controversy requirement was met. Based on a prior order of the court, Reilly only had standing to assert claims based on the three products she purchased. Amy's Kitchen contended the sales of the three products in Florida during the class period totaled only $1,045,993. Reilly argued the value of the injunctive relief she sought, along with potential attorneys fees and costs, should be included in calculating the amount in controversy. However, she did not specify a value for the injunctive relief or a dollar amount for a potential award of fees and costs. The district court held it lacked subject matter jurisdiction. Reilly failed to show that an award of attorneys' fees and costs and/or the value of injunctive relief would raise the amount in controversy from $1,045,993 to $5 million.
