The Eighth U.S. Circuit Court Gives Verdict in Favor of Prudential Insurance Co. of America

The Eighth U.S. Circuit Court of Appeals held an insurer did not abuse its discretion in denying an insured long-term disability (LTD) benefits under a group policy sponsored by his former employer. On May 10, 2010, Michael Prezioso injured his back lifting a 15-pound art portfolio while working as an advertising sales representative for Vertis Inc. On May 11, Dr. John Dowdle diagnosed acute mechanical low back pain and degenerative disc disease of the lumbar spine. When the pain did not quickly resolve, Dowdle ordered an MRI of Prezioso's lumbar spine. When recommended treatments did not alleviate the pain, Prezioso applied for LTD benefits under Vertis' LTD plan, which was administered by the Prudential Insurance Co. of America. To be eligible for LTD benefits under the plan, an employee must be continuously disabled throughout a 180-day elimination period. Prudential denied Prezioso's application, finding he was not continuously disabled. After exhausting his administrative remedies, Prezioso brought an action under ERISA alleging Prudential wrongly denied him LTD benefits. The district court granted summary judgment dismissing his claim, and Prezioso appealed. The Eighth Circuit affirmed the district court's judgment. Prudential did not abuse its discretion in deciding that Prezioso was not continuously disabled within the meaning of the LTD policy and, therefore, not entitled to LTD benefits. Its decision was reasonable and supported by ubstantial evidence.

Prudential Group Insurance Appoints Michelle Crecca as Senior Vice President of Strategy, Chief Marketing Officer

Michelle Crecca has been appointed Senior Vice President of Strategy and Chief Marketing Officer for Prudential Group Insurance, a business of Prudential Financial Inc. In her newly created role, Crecca will be responsible for integrating strategy, marketing and communications functions while increasing visibility and understanding of the brand and value proposition among key stakeholders. Crecca most recently served as Executive Vice President and Chief Marketing Officer with Webster Financial Corporation. Crecca started with Webster in 2006 and was quickly promoted to Chief Marketing Officer. Prior to her career at Webster, Crecca spent seven years with Citigroup, progressing through various marketing, line of business and product and channel management roles.
