Bonhomme Investment Partners LLC Files Lawsuit Against Truman Bancorp, Simmons First National Bank and Federal Deposit Insurance Corp

A new lawsuit filed in federal court last week alleges former bank executive Shaun Hayes made misrepresentations regarding a $6 million loan while working as a consultant for Truman Bank. Bonhomme Investment Partners LLC, Donald Davis and Richard Lehman filed the lawsuit against Hayes on March 14. Other defendants named in the civil suit include Truman Bank's holding company, Truman Bancorp; the estate of Richard Miller, Truman's former CEO who died in December; Simmons First National Bank, which took over the failed Truman Bank; and the Federal Deposit Insurance Corp., in its role as receiver for Truman Bank. In the suit, Davis and Lehman allege Bonhomme agreed to loan Truman Bancorp $6 million in 2009, with Truman pledging all of its stock and shares in the stock of bank holding company FFC Financial Corp. as security. Davis and Lehman allege Truman Bancorp was not entitled to pledge the stock because it was already pledged to secure other obligations.
