Preferred Mutual Insurance Company Faces Lawsuit for Failure to Pay for Flood Damage

Preferred Mutual Insurance Company is the defendant in a lawsuit that alleges the company wrongfully failed to pay more than $105,381 in flood damage on a New York property. 450 Margaret Street Properties purchased flood insurance from Preferred prior to the damage that occurred in April 2011. The property suffered additional flood damage in June 2011. The lawsuit claims an adjuster determined that the property had suffered $105,381 in damages due to partial collapse of the building and that the plaintiff would be forced to incur additional expenses related to demolition and environmental remediation. The suit claims that Preferred denied the claim and alleged that the damage was caused by the weight of stored items and long term immersion in water, but later agreed to pay approximately half of the requested amount following the plaintiff's appeal to FEMA. The claimant alleges Preferred has yet to pay the agreed upon amount and continues to deny liability for the remainder of the plaintiff's damage.
