American Environmental Group Files Lawsuit Against HM Miller, the City of Fremont and Westfield Group in Sandusky County Common Pleas Court

American Environmental Group filed a lawsuit in Sandusky County Common Pleas Court, naming HM Miller, the City of Fremont and Westfield Group as defendants and seeking more than $1.6 million in payment for liner installation work. The liner was an addition to original reservoir plans, necessitated by the presence of karst, porous stone that would drain water out of the reservoir. AEG, in its complaint, states that the city approved all of its work on the reservoir project and there are no disputes as to the quality of the work. The reservoir, originally scheduled to be operational by now, has seen costs climb from $15 million to $40 million, including a $12.8 million change order claim submitted to the city by HM Miller, the second contractor hired for the project after the city fired Trucco Construction. The city and HM Miller spent months exchanging letters and e-mails about the change order and the project. The city accepted only $12,234 of HM Miller's claim for the reservoir project, and engineering firm Arcadis mailed HM Miller a detailed, itemized response that explained the engineering firm's reasons for rejection under terms of the reservoir contract.
