A Federal Bankruptcy Court to Consider Complaint from Former Employees of DesignLine Corp

A federal bankruptcy court judge is scheduled to consider a complaint from former employees of DesignLine Corp. who say they were improperly terminated from their jobs. DesignLine workers says they were terminated from their jobs on July 31, according to the class-action filing. The company issued a statement that day that  the plant was temporarily closing for 10 days. But, according to the suit, the workers weren't called back. And, they weren't properly discharged from their jobs as is required under the federal  Worker Adjustment and Retraining Notification Act, the filing states. The WARN Act calls for 60-days advance notice of termination that's the ‘reasonable foreseeable result of a plant closing,’ the suit says. The plaintiffs are petitioning the court for damages in the amount of 60 days pay and benefits. About 300 other employees worked or reported to the DesignLine plant on Nevada Boulevard in Charlotte, the suit says.

New Jersey Transit Cancel a Major Contract with DesignLine Corp

New Jersey Transit successfully asked a bankruptcy court to cancel a major contract with DesignLine Corp. following the auction of the Charlotte busmaker's assets to a California investor. The termination of the contract to produce 76 buses fueled by compressed natural gas signals further complications for the company to resume production. Federal Judge J. Craig Whitley approved New Jersey Transit's request Nov. 1.
