tcc Loses Appeal over Nutello Brew

tcc has failed in its appeal to be allowed to call one of its coffee brews 'Nutello'. The Court of Appeal in judgment grounds that the name infringed Ferrero's nutella, the trademark for its hazelnut spread launched in 1963. Ferrero SpA had won its bid in the High Court in July last year to stop the coffee chain calling one of its coffee brews 'Nutello'. In August 2007, the tcc chain introduced the Nutello coffee drink, which used nutella as a key ingredient. It took the drink off its menu after its own review in 2010, but by then, Ferrero had gone to court to stop the coffee chain using the Nutello name. Singapore-based Sarika Connoisseur Cafe, which runs tcc, appealed against the High Court move at a hearing in January 2012. But the three-judge Court of Appeal, in reserved judgment grounds issued on October 18, 2012, upheld Ferrero's contention. The court, in its 62-page judgment, found that not only are the products similar, but the names also sounded and looked similar. Senior Counsel Tan Tee Jim, representing Sarika, had argued the rising sales in nutella's spread showed there was no confusion between the two products. But the appeals court said the confusion lay in the public 'being made to labour' under the impression that Nutello was somehow related to or has some business connection with nutella.
