Measat Broadcast Network Systems Berhad Enters into Agreement with TM Net Sdn Bhd for the Carriage of Two Astro SuperSport

Measat Broadcast Network Systems Berhad entered into an agreement with TM Net Sdn Bhd for the carriage of two Astro SuperSport channels on HyppTV. In addition, the parties have agreed to enter into a further agreement for the carriage of selected NJOI channels subject to certain conditions. Astro SuperSport HD and Astro SuperSport 2 HD Channels will be made available from 1 August 2013 until 31 July 2016, and will contain selected live matches from the Barclays Premier League’s Seasons 2013/14, 2014/15 and 2015/16 and other sports content.

Measat Broadcast Network Systems Provides Update on Civil Suit

Astro Malaysia Holdings Bhd's wholly owned subsidiary Measat Broadcast Network Systems Sdn Bhd (MBNS), a defendant in a civil suit in Indonesia, has been officially served with the statement of claim which includes immaterial loss of USD 20 billion (MYR 60.8 billion). In a statement filed to the exchange April 25, 2013, Astro said that mediation was held on Wednesday where the official statement of claim was served by plaintiff PT Direct Vision (PTDV) for damages for an alleged unlawful act of tort. The statement added that the damages arose from a dispute over a bungled direct-to-home (DTH) pay-TV business in Indonesia which had been the subject of past litigation and arbitration proceedings since 2008. Astro had in 2005 formed a joint venture with First Media and other affiliates of the Indonesian Lippo Group with the purpose of setting up a DTH pay television business in Indonesia. The joint venture was not concluded and Astro commenced arbitration proceedings against the Lippo Group in Singapore. The arbitration proceedings, which were commenced in Singapore under the Singapore International Arbitration Centre (SIAC) Rules concluded in favour of both MBNS and Astro All Asia Networks in final and binding SIAC Awards amounting to approximately USD 303 million. PTDV did not challenge the enforceability of the arbitration in Singapore. PT First Media Tbk applied to refuse its enforcement in Singapore and appealed after judgment which was released to the parties on October 23, 2012. The High Court of Singapore confirmed the enforceability of the SIAC Awards as a court judgment in Singapore. The appeal has been heard before the Court of Appeal from April 10 to 12, 2013, and the Singapore Court of Appeal has since reserved judgment.

AcrossAsia Limited Pays in to Court the Sum of USD 46,774,403 as Security Pending

Further to the announcement made on January 29, 2013, Astro Malaysia Holdings Berhad announced that, MEASAT Broadcast Network Systems Sdn Bhd, other plaintiffs have on February 6, 2013 obtained the orders from the Hong Kong High Court, that AcrossAsia Limited pay in to Court the sum of USD 46,774,403 by February 18, 2013 as security pending the outcome of the garnishee proceedings initiated by the Plaintiffs as part of its enforcement of the arbitration awards issued in favour of the Plaintiffs by the arbitral tribunal constituted under the Singapore International Arbitration Centre against PT First Media Tbk and others (SIAC Arbitration No. 062 of 2008), the final award of which was issued in February 2010; that with the Plaintiffs providing a qualified undertaking as to damages, the interim anti-suit injunctions against the Garnishee obtained on January 24, 2013 be continued; and that the interim anti-suit injunctions against PT First Media Tbk be continued pending the outcome of the garnishee proceedings.
