Covidien Files Patent Infringement Lawsuit over Ethicon Endo-Surgery, Inc.'s Ultrasonic Surgical Devices

Covidien announced that it filed a lawsuit in the U.S. District Court for the District of Connecticut against Ethicon Endo-Surgery, Inc. The lawsuit alleges that Ethicon's latest ultrasonic surgical product, the Harmonic ACE(R)+7, infringes three Covidien patents. The same federal court found that these patents were valid and had been infringed in an earlier lawsuit relating to other Ethicon ultrasonic surgical products. The lawsuit contends that U.S. Patents 6,063,050; 6,468,286; and 6,682,544 are infringed by Ethicon's Harmonic ACE(R)+7 Shears. Ethicon's Harmonic devices were found to infringe the same patents in a prior suit in the same court that resulted in a damages award against Ethicon of more than $175 million, a finding that is currently under appeal. The new suit asks the court to enjoin Ethicon from continuing to make and sell the Harmonic ACE(R)+7 device and to grant damages for the patent infringement.

Ethicon Launches Harmonic Ace(R) +7 Shears with Advanced Hemostasis

Ethicon Endo-Surgery, Inc. announced the launch of HARMONIC ACE(R) +7 Shears with Advanced Hemostasis (HARMONIC ACE(R) +7), the first purely ultrasonic device with a 7 mm sealing indication. HARMONIC ACE(R) +7 combines the precision and multi-functionality expected of HARMONIC(R) with reliable large vessel sealing; a benefit combination that does not exist in any other product, representing a true breakthrough in ultrasonic energy technology. The new device will be featured at The American Society of Colon and Rectal Surgeons (ASCRS) Annual Scientific Meeting in Hollywood, FL this week. The HARMONIC ACE(R) +7 is setting a new standard in ultrasonic energy by demonstrating larger vessel sealing strength using the Advanced Hemostasis mode. Benchtop testing shows: Greater 5 to 7 mm vessel-sealing reliability than LigaSureTM devices1; 140% higher median burst pressure vs LigaSureTM 5 mm Blunt Tip, when sealing 5 to 7 mm vessels in the Advanced Hemostasis mode2; 112% higher median burst pressure vs LigaSure Advance(TM), when sealing 5 to 7 mm vessels in the Advanced Hemostasis mode3. The addition of the 7 mm vessel sealing capability to the HARMONIC ACE(R) +7 makes it an optimal tool for laparoscopic colon surgery. It provides the same precise dissection that I've become accustomed to from the HARMONIC ACE(R) and now with larger vessel sealing capability.
