Lembaga Kemajuan Tanah Persekutuan and Felda Palm Industries Sdn Bhd Receive Writ of Summons and Statement of Claim

On behalf of Felda Global Ventures Holdings Berhad, CIMB Investment Bank Berhad and Maybank Investment Bank Berhad announced that Lembaga Kemajuan Tanah Persekutuan (Federal Land Development Authority (“FELDA”)) and Felda Palm Industries Sdn Bhd (“FPI”), had on 18 June 2012 received a writ of summons and statement of claim dated 5 June 2012 filed by Md Hamidin Ab Rani and 956 other settlers in Rancangan Felda Keratong 1 – 10 in Pahang (“the Plaintiffs”) at the Kuantan High Court vide Civil Suit No. 22NCVC-129-6/2012. The Plaintiffs alleged that FELDA as the 1st defendant and FPI as the 2nd defendant had, defrauded the Plaintiffs and/or conspired to defraud the Plaintiffs with regard to the sale of oil palm fruits cultivated by the Plaintiffs by the grading system of the Graded Extraction Rate and the weighing system of the palm fruits to reduce the Graded Extraction Rate. The Plaintiffs’ claims against the defendants are as follows: 1st defendant and 2nd defendant to pay special damages to the Plaintiffs based on the total production and fresh fruit bunch palm oil price for each year commencing from 1995; Plaintiffs will rely on Section 22 of the Limitation Act, 1953; 1st defendant and 2nd defendant to pay general and exemplary damages for fraud and breach of trust, interest rate of 4% per annum on special damages commencing from 1995, interest rate of 8% per annum on general damages from the date of filing of this writ until full payment costs and further or other relief.
