Three Chinese solar panel makers seek the dismissal of a lawsuit against them by Solyndra LLC. The defendants asserted the former solar panel maker of Fremont, had failed to prove the Chinese companies had conspired to destroy their American rivals and failed to prove it suffered antitrust injury. Judge Saundra Brown Armstrong of the U.S. District Court for the Northern District of California in Oakland is set to consider dismissing the lawsuit on June 4. Solyndra on Oct. 11 sued Suntech Power Holdings Co. Ltd., Suntech America Inc., Trina Solar Ltd., Trina Solar (U.S.) Inc., Yingli Green Energy Holding Co. Ltd. and Yingli Green Energy Americas Inc., alleging they collaborated to flood the United States solar market with solar panels at below-cost prices" to achieve market domination. Solyndra noted it was not the only solar company to file for bankruptcy due to the low-cost Chinese panels. At least seven other solar companies have filed for bankruptcy since August 2011. The lawsuit seeks $1.5 billion in damages. The defendants on March 8 requested dismissal of the lawsuit, calling Solyndra's assertions an "implausible theory" because Solyndra alleged they conspired to injure Solyndra even before Solyndra entered the solar market. They further alleged Solyndra went out of business due to market competition, not because of any malicious intent. Solyndra filed for bankruptcy on Sept. 6, 2011, and its liquidation plan took effect on Nov. 7.
