Consumer Watchdog and Shernoff Bidart Echeverria Bentley LLP, on behalf of certain plan enrollees, filed a class-action lawsuit against Blue Cross of California, alleging that the company misrepresented the size of its physician and hospital networks and other health plan contract terms to boost sales during the Affordable Care Act's open enrollment period. Consumer Watchdog and Shernoff Bidart Echeverria Bentley LLP filed the suit, which also alleges that the company delayed consumers' enrollment in new health plans and subjected them to ‘exceedingly long wait times’ for customer service. The company declined to comment on the suit, which was filed on behalf of individual plan enrollees between October 1, 2013, and March 31, 2014. However, Anthem Blue Cross told the news outlet that some doctors were not listed accurately on its plans and that the company has agreed to pay claims for enrollees treated by those doctors during the first three months of 2014. Consumer Watchdog said that its lawsuit seeks to require the company to set up sufficient provider networks and administer plans in compliance with California law. It also demands that consumers be reimbursed.

Los Angeles City Attorney Settles Anthem Blue Cross Lawsuit for $6 Million

Los Angeles City Attorney Carmen Trutanich has settled a lawsuit that Anthem Blue Cross illegally dropped more than 6,000 policyholders from coverage for $6 million. The settlement is a far cry from the $1 billion in fines and restitution former City Attorney Rocky Delgadillo threatened when the lawsuit was filed in 2008. Deputy City Attorney Will Pirkey says none of the people who initially worked on the case for Delgadillo still work in the office and the current staff is satisfied with the settlements.

Doctor Wins Suit Against Anthem Blue Cross

In a rare case, a Los Angeles jury awarded $3.8 million in compensatory damages to a Porter Ranch doctor who contended insurance giant Anthem Blue Cross retaliated against him for being a strong patient advocate. The jury ruled in favor of Jeffrey Nordella, 58, an urgent-care and family-practice doctor who alleged that Anthem barred him from its network in 2010, when he applied to be a preferred provider. The damages could climb higher when the 12-person panel reconvenes and considers punitive damages against Anthem. The jury found that Anthem violated Nordella's right to 'fair procedure', and the company did so with 'malice, oppression or fraud'. That latter finding prompted the hearing on April 12, 2013 in Los Angeles County Superior Court to determine punitive damages.
