Texas Jury Rejects $3.5 Million Lawsuit against FFE Transportation Services Inc

A Texas district court jury has awarded a take-nothing verdict in favor of FFE Transportation Services Inc. after rejecting a $3.5 million lawsuit filed by the City of Saint Jo following an automobile accident that took place nearly four years ago. Jurors found that FFE Transportation was not at fault for a May 4, 2010, accident between a company rig and a police car driven by former Saint Jo police officer Billy Reynolds. The northern Texas city claimed the truck driver failed to yield to an emergency vehicle, among other alleged infractions. Jurors delivered their verdict in favor of the company on Jan. 14 in Judge Jack McGaughey's 97(th) District Court in Montague County. Trial lawyer Bill Chamblee, managing partner of Dallas Chamblee, Ryan, Kershaw & Anderson, P.C., and fellow Chamblee Ryan attorney H. Peyton Inge IV successfully defended FFE Transportation during the six-day trial. The jury deliberated for only five minutes before reaching its verdict.

On April 11, 2013, FFE Transportation Services, Inc., Lisa Motor Lines, Inc., Conwell Corporation, and FFE Logistics, Inc., and Frozen Food Express Industries, Inc. and certain of its subsidiaries, executed the Third Amendment to a certain Loan and Security Agreement, dated March 28, 2011 (the "Credit Agreement"), by and among the Borrower, the Guarantors and Bank of America, N.A., as Agent Bank for the lenders under the Credit Agreement. The Credit Agreement originally defined the Letter of Credit Subline as $7.5 million, setting this amount as the maximum aggregate limit for letters of credit that could be issued under the agreement. This Amendment restates the Letter of Credit Subline, increasing the amount to $10 million. As amended by this Amendment, the First Amendment dated March 29, 2012 and the Second Amendment dated December 19, 2012, the Credit Agreement remains in full force and effect.
