Xoom Corporation (the Company) entered into an office lease agreement dated December 20, 2013 with Metropolitan Life Insurance Company to lease approximately 53,017 square feet of an office building located at 425 Market Street, San Francisco, California. The 120-month term of the Lease (the Term) is expected to commence on July 1, 2014. Rent will be paid on a monthly basis and will increase incrementally from $229,740.33 per month to $286,914.20 per month through the end of the Term. In connection with the entry into the Lease, the Company is obligated to deliver a letter of credit to the Landlord in the amount of $3,890,949.00. The Company has the option to extend the term of the Lease for an additional five year period at the then prevailing market rate. The Company also has the right to sublease, assign or transfer the Premises, subject to certain terms and conditions.

Thomas A. Tully Sues Lorillard Tobacco Co, Georgia-Pacific LLC, Metropolitan Life Insurance Company and Union Carbide Corporation

The estate of former Dubuque mayor Thomas A. Tully filed a suit against Lorillard Tobacco Co. and 14 others for Tully, who died at the age of 69 in April 2010. The trial is set for Jan. 14, 2014, with an estimated length of two weeks. The executors of the estate are Joan Tully and her children, Thomas P. Tully and Maureen Lindecker. The elder Thomas Tully contracted mesothelioma, a common affliction for those who inhaled smoke from Kent Micronite cigarettes in the 1950s. Besides Lorillard, the petition names Georgia-Pacific LLC, Union Carbide Corporation and Metropolitan Life Insurance Company among the defendants, along with "various unknown John Does" to be named when identified. The estate alleges negligence, strict liability for manufacture and sale of defective products, breach of express and implied warranties of merchantability and fitness for intended purposes, conspiracy, fraud and loss of consortium. Among other claims, the Tullys say the companies failed to adequately test their products, and that, specifically, Metropolitan Life conspired with its insureds and other asbestos product manufacturers and distributors to suppress and distort information. The Tully family is asking for an unspecified amount of past and future damages. The defendants have until mid-April to designate between one and three people as liaison counsel who will coordinate motions and pre-trial matters.
