Soros Quantum Partners, Knighthead Master Fund, Hayman Capital Master Fund, and RGY International Sue Bank of New York Mellon in Ongoing Argentine Dispute

A group of hedge funds filed a lawsuit in London's Chancery Division of the High Court of Justice against Bank of New York Mellon (BONY). BONY, as trustee handling Argentina's bond payments, oversees payments to Argentina's bond investors. The plaintiffs - Soros Quantum Partners, Knighthead Master Fund, Hayman Capital Master Fund, and RGY International (a unit of Perry Capital) claim that BONY's London unit must distribute €226 million ($298 million) of interest payment on the Argentine bonds. The money was deposited by Argentina for its euro-denominated bondholders. The hedge fund plaintiff group, which holds $1.7 billion of Argentine government bonds, claims the interest payment is under UK law and not subject to the US injunction. On July 30, Argentina defaulted after Judge Griesa ruled that Argentina would have to pay the holdout creditors at the same time as the exchange bondholders. Griesa said that anyone who tried to help Argentina make the payment would be in contempt of court. While Argentina made the $539 million interest payment to BONY for the exchange bondholders, BONY did not pass it onto investors because it believed it would be violating Griesa's orders. Argentina wants to remove BONY as its trustee and replace it with state-run Banco de la Nacion. Argentina claims that by not sending the interest payment to bondholders, BONY broke its contract. Griesa said the move was illegal but did not hold Argentina in contempt of court. BONY has also been sued by a group of Belgium euro bondholders who want their interest payment. They are threatening to sue in UK courts if BONY returns the money to Argentina.
