Bank of New York Mellon Corp. Faces Legal Action by Argentinian Bondholders

The Bank of New York Mellon Corp.'s ongoing problems with Argentinian bondholders has taken a new twist as funds holding the restructured bonds have begun legal actions against the bank in a Belgian court. The funds also took action against Euroclear. For BNY Mellon, it comes down to a $539 million deposit it received late last month from the Argentine government against U.S. Judge Thomas Griesa's orders. BNY Mellon last week sought guidance from Griesa on how to handle the situation. The bank was in a delicate situation, facing a potential lawsuit by the Argentine bondholders but also dealing with a U.S. court order blocking payment. Griesa said the Argentine government had to pay bondholders that accepted two sovereign debt restructurings at the same time it paid investors that held out from the exchanges and won a court-awarded $1.33 billion plus interest. Griesa has said BNY Mellon should return the money to Argentina but did not provide instructions. If Argentina does not reach a deal with the bondholders by the end of July, the country risks another sovereign debt crisis. The funds are saying the payment made to a BNY Mellon account at Central Bank of Argentina should be sent to a Belgian entity in Frankfurt, then to investors through clearinghouses in Europe and that Griesa's orders should not disrupt the process.

BNY Mellon Announces Executive Changes

BNY Mellon has appointed Werner Taiber as new country executive for Germany in addition to his role and responsibilities as CEO of Meriten Investment Management. Taiber replaces Fred Bromberg, who is leaving Germany to take on an expanded role as a senior client executive within BNY Mellon's global client management group, based in New York and reporting to Karen Peetz, president of BNY Mellon. Bromberg will remain a member of the German management committee while he works with Taiber to ensure a seamless transition. Taiber takes up his new role effective July 1, 2014. He will continue to be based in Dusseldorf, reporting to Michael Cole-Fontayn, BNY Mellon's chairman of Europe, Middle East & Africa, and Mitchell Harris, president, BNY Mellon Investment Management. As regional executive, Werner will lead the company's local management team in executing organic growth plans, implementing client coverage and servicing model and developing strong relationships with regulators.
