Fluor Corporation Receives 3-Year Contract for Paducah Deactivation and Shutdown from U.S. Department of Energy

Fluor Corporation was chosen by the U.S. Department of Energy (DOE) for the next phase of cleanup at the Paducah Gaseous Diffusion Plant (GDP) in Paducah, Kentucky. Fluor is the prime contractor for the management, integration and execution of the deactivation and post-GDP shutdown remediation activities at the Paducah site. It is anticipated that the new contract will help reduce environmental risks and create local job opportunities. The estimated value of the contract, which Fluor booked in the third quarter of 2014, is approximately $420 million over three years. The DOE Paducah GDP is located in Western Kentucky, approximately 10 miles west of Paducah and 3.5 miles south of the Ohio River. The Paducah GDP is a 3,423-acre federal reservation that was built in the 1950s as part of the nation's nuclear weapons complex and enriched uranium from 1952 until 2013. Limited cleanup activities have been underway since 2010. For the Paducah GDP work, Fluor's scope of work will include the management, integration and execution of the deactivation and post-GDP shutdown remediation activities at the site along with cleaning up and remediating contaminated soils and groundwater.

Fluor Corporation Wins LNG Terminal Contract in Rotterdam

Fluor Corporation was awarded a contract by Gate Terminal BV, to design and build a liquefied natural gas (LNG) break bulk terminal in Rotterdam, the Netherlands. Fluor booked the contract for an undisclosed value in the second quarter of 2014. Fluor will provide engineering, procurement and construction management services for the jetty, loading facilities, boil-off gas compressors, connection to the LNG terminal and other facilities. Break bulk terminals split up large-scale LNG shipments into smaller quantities to facilitate the distribution of LNG to be used as fuel for ships and heavy trucks. Fluor's office in Spain, which has completed LNG projects globally, will be responsible for executing the project. Gate Terminal anticipates the terminal will be ready for operation in 2016.

The Court of Appeals Eastern District Orders Fluor Corporation to Pay $240 Million in Punitive Damages

The Court of Appeals Eastern District threw out $240 million in punitive damages against Fluor Corp. Following a three-month trial in 2011, a St. Louis jury had ordered Fluor and two subsidiaries to pay a total of $358.5 million to 16 plaintiffs, all of whom grew up near the smelter and had suffered lead poisoning as children. The appeals court upheld portions of the jurya's verdict, including the full $38.5 million in compensatory damages and $80 million in punitive damages against two of Fluora's subsidiaries, through which Fluor operated the smelter. Fluor also had been ordered to pay punitive damages of $15 million to each of the plaintiffs. But the Eastern District said that award rested on an incorrect legal theory by the plaintiffs. As a result, the punitive damages against the corporation will have to be retried. The lawsuit alleged that Fluor and its subsidiaries were negligent in failing to address the known risks of lead poisoning in the town. The appeals court said the plaintiffs â easily provede that part of the case. Fluor, however, was separately held liable as the parent company that had controlled the smelter. The jury instructions on that count were drawn from Missouri cases on agency law. But the Eastern District said there has been confusion in the caselaw between two different ways to hold parent corporations responsible for the acts of their subsidiaries.
