Federal Judge Sends Important Wrongful Death Lawsuit Against General Motors Back to a Georgia Court

A federal judge in Atlanta has sent an important wrongful death lawsuit against General Motors back to a Georgia court. Judge Thomas Thrash Jr. ruled that a Cobb County judge should handle the case filed by the family of Brooke Melton. GM had moved the case to the federal court system. Melton, a 29-year-old nurse, died in a 2010 car crash near Atlanta. Her parents sued GM alleging that a faulty ignition switch in her 2005 Chevrolet Cobalt unexpectedly shut off the engine, causing her to lose control of the car. The case exposed that GM knew about the faulty switches for more than a decade but failed to recall the cars until 2014. It also touched off a crisis at the company that has resulted in 54 recalls involving 29 million vehicles in 2014. And it brought federal investigations, cover-up allegations and a $35 million fine from federal regulators for delays in reporting safety problems. Even though the case was sent back to a local court, the Meltons still have to convince Cobb County Judge Kathryn Tanksley to reopen it, which judges normally frown upon. They settled last year with GM for $5 million, but are willing to return the money and take the case to trial. To reopen the case, lawyers must prove that GM fraudulently concealed evidence. But Beasley says he's confident they'll be able to do that. GM lawyers filed a motion in Cobb County to dismiss the Melton case, contending that the fraud claim could have been made before the settlement.

Shapiro Haber & Urmy LLP Files a Class Action Against General Motors on Behalf of its Client, Geri Siano Carriuolo and Other Purchasers of General Motors Cars

Shapiro Haber & Urmy LLP, has filed a Class Action in the United States District Court for the Southern District of Florida against General Motors (GM) on behalf of its client, Cadillac owner Geri Siano Carriuolo, and other purchasers of General Motors cars that had new car window labels (called Monroney stickers) with false crash safety ratings. The new car window sticker on Ms. Carriuolo's 2014 Cadillac CTS Sedan falsely stated that model Cadillac had been subjected to three different crash tests -- Frontal Crash Driver, Frontal Crash Passenger, and Rollover -- by the National Highway Traffic Safety Administration (NHTSA) and had obtained a five-star rating by the NHTSA (the high possible rating) for each of those crash tests. GM has since admitted that the 2014 Cadillac CTS Sedan, the CTS VSport, and other Cadillac models not only had not received five-star crash test ratings, they in fact had not been crash tested by the NHTSA at all! In addition to Shapiro Haber & Urmy, the plaintiff and the class are represented by the West Palm Beach, Florida law firms: Liggio Benrubi PA and Clark, Fountain, La Vista, Prather, Keen & Littky-Rubin. The complaint alleges that as a result of GM's false representations regarding the crash test results, the plaintiff and class members suffered damages due to the significant decrease in the value of the cars they purchased. The plaintiff seeks to recover those damages for herself and other purchasers of those cars.

General Motors Company is planning to invest around USD 27 million at its plant in Bedford, Indiana, USA. The company is investing to purchase production equipment for casting. The Economic Redevelopment Commission has recommended 100% tax abatement over a ten-year period on the investment.
