Judge Dismisses Part of CDS Antitrust Action Against Banks

U.S. District Judge Denise Cote in Manhattan granted motions to dismiss part of an antitrust action brought against several financial institutions for allegedly conspiring to limit competition in the credit-default swaps market. U.S. District Judge Denise Cote in Manhattan granted motions to dismiss part of an antitrust action brought against several financial institutions for allegedly conspiring to limit competition in the credit-default swaps market, while allowing the other claims in the lawsuit to proceed. The judge noted that the plaintiffs' claim that the companies collectively sought to monopolize the credit default swaps market does not support a section 2 attempt-to-monopolize claim of the Sherman Act. The plaintiffs also claimed that the firms attempted to limit competition in the CDS market - claims the companies still face. The consolidated complaint was filed on behalf of all investors who purchased credit default swaps from January 2008 to December 2013 from certain banks. The defendants named in the suit are JPMorgan Chase & Co., Goldman Sachs Group Inc., Bank of America Corp., Citigroup Inc., Morgan Stanley, BNP Paribas SA, Credit Suisse Group AG, HSBC Holdings Plc, Royal Bank of Scotland Group Plc, Deutsche Bank AG, UBS AG and Barclays Plc.
