RT Briscoe (Nigeria) plc has been sued at the Ikeja High Court by a media consultant, Lolade Fadeyi, for allegedly selling a substandard Toyota car to him three years ago. Fadeyi is asking for NGN 2,000,000 as general and special damages as well as a replacement of his vehicle with a brand new and faultless one. However, when the matter came up for mention on July 4, 2011, before Justice Josephine Oyefeso for the second time, it had to be adjourned as a result of the non-legal representation of the defendant, R.T. Briscoe. The court that the defendant had filed their statement of defence but it had failed to appear in court for the two consecutive times the matter had come up. Justice Oyefeso then directed that the claimant should apply for pre-trial-conference and notify the defendant about the development, so that trial can begin. In his statement of claim, Fadeyi contended that he bought a Toyota Corolla 1.8 GLI from the defendant on September 24, 2008 at NGN 3,450,000, adding that since the purchase, he had been experiencing untold hardship due to malfunctioning of the car because he started visiting the workshop of the defendant barely two weeks after the purchase. He stated further that he kept going back to various sections, including the workshop, sales and customer care units of the defendant's company for diverse complaints on the vehicle. However, the defendant in its statement of defense contended that although the car has a three-year warranty, the claimant had not strictly kept to the terms of the purchase. Justice Oyefeso has adjourned the matter till September 27 for hearing.
