Seasonality This segment experiences seasonal effects as demand for gasoline products is higher during the summer months than during the winter months due to seasonal increases in highway traffic and road construction work. Demand for diesel fuel is higher during the planting and harvesting seasons. As a result, this segment’s results of operations for the first and fourth calendar quarters (year ending December 2013) are lower compared to its results for the second and third calendar quarters. In addition, unseasonably cool weather in the summer months and/or unseasonably warm weather in the winter months in the markets in which this segment sells its petroleum products could impact the demand for gasoline and diesel fuel. The demand for asphalt is also seasonal and is higher during the months of March through October. Competition This segment’s competitors include Phillips 66, HollyFrontier Corporation, NCRA, Valero Energy Corporation, and Flint Hills Resources. Nitrogen Fertilizer segment This segment consists of a nitrogen fertilizer facility in Coffeyville, Kansas that is the only operation in North America that uses a petroleum coke, or pet coke, gasification process to produce nitrogen fertilizer. The nitrogen fertilizer facility includes a 1,225 ton-per-day ammonia unit, a 3,000 ton-per-day UAN unit and a gasifier complex with built-in redundancy having a capacity of 84 million standard cubic feet per day of hydrogen. A majority of the ammonia produced by the nitrogen fertilizer plant is further upgraded to UAN. Distribution, Sales, and Marketing The primary geographic markets for this segment’s fertilizer products are Kansas, Missouri, Nebraska, Iowa, Illinois, Colorado, and Texas. This segment markets the UAN products to agricultural customers and the ammonia products to industrial and agricultural customers. Customers This segment sells UAN products to retailers and distributors. In addition, it sells ammonia to agricultural and industrial customers. Some of its major customers include Gavilon Fertilizer, LLC; United Suppliers, Inc.; Crop Production Services, Inc.; J.R. Simplot, Inc.; Interchem; and MFA. Seasonality This segment generates greater net sales in the first half of each calendar year, which is referred to as the planting season, and its net sales tend to be lower during the second half of each calendar year, which is referred to as the fill season. Competition This segment’s competitors include Agrium, Koch Nitrogen, Potash Corporation, and CF Industries. Environmental Matters The principal environmental risks associated with the company’s businesses are the Federal Clean Air Act and the federal Clean Water Act. The U.S. Environmental Protection Agency (EPA) has conducted inspections and issued information requests to the company with respect to its compliance with release reporting requirements under the Comprehensive Environmental Response, Compensation and Liability Act; and the Emergency Planning and Community Right-to-Know Act. The company’s operations are subject to the Resource Conservation and Recovery Act requirements for the generation, transportation, treatment, storage, and disposal of solid and hazardous wastes. It is subject to a 1994 EPA administrative order related to investigation of possible past releases of hazardous materials to the environment at the Coffeyville refinery. The company is subject to various federal and state laws and regulations related to safety, including the Occupational Safety and Health Act (OSHA) and comparable state statutes, the purpose of which are to protect the health and safety of workers.
